Refund requests must be submitted in writing to support@thedatogroup.xyz within 30 days of the transaction.

Disputed Charges: If you dispute a charge, notify us immediately at support@thedatogroup.xyz. We will investigate and respond within 10 business days.

No Refund for Service Agreement Non-Performance: Except as specified in our Performance Guarantee (see your service agreement), we do not provide refunds for services. Disputes regarding service quality should be addressed through the dispute resolution process outlined in your service agreement.

9. Service Agreements

When you become a client of The Dato Group, you will enter into a separate service agreement that outlines the specific services, deliverables, timeline, and fees.

Relationship to These Terms: These Terms and Conditions apply to your use of the Website and general interactions with The Dato Group. Your service agreement governs the specific services we provide and supersedes these Terms to the extent of any conflict.

Performance Guarantee: The Dato Group offers a Performance Guarantee on specified engagements. Details of the guarantee are outlined in your service agreement. This guarantee is the sole remedy for service non-performance.

Confidentiality: During our engagement, The Dato Group may receive confidential information about your business. We agree to maintain strict confidentiality and will not disclose this information to third parties except as necessary to deliver services or as required by law.

Termination: Either party may terminate the service agreement according to the terms specified in that agreement. Upon termination, all confidential information will be returned or destroyed as requested.

10. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Violating any applicable laws, regulations, or third-party rights

Harassing, abusing, defaming, or threatening any person or entity

Transmitting spam, malware, viruses, or malicious code

Attempting to access the Website or systems without authorization

11. Indemnification

Resolution Period: We will respond within 15 business days of receiving your notice. If the dispute is not resolved within 30 days, either party may pursue legal remedies.

Escalation: For service agreement disputes, escalation procedures and mediation requirements are outlined in your specific service agreement.

16. Entire Agreement

These Terms and Conditions, together with any service agreements, Privacy Policy, and other policies referenced herein, constitute the entire agreement between you and The Dato Group regarding your use of the Website and our services. These Terms supersede all prior understandings, representations, and agreements, whether written or oral.
